the caldecott tunnel and you can see traffic is moving nicely and if you are driving that traffic looks good. let's go back to dave and pam. we do have exclusive pictures of police. clearing out an occupied camp, christian captain is there outside the federal reserve bank where they are fusing to -- refusing to stay away. >> you can see the year long used to be occupied by protesters and they are now replaced by a fence awning see some of those protesters returning to the site and just to the left of that you can see there is a large police presence here as well. that chain link fence is posted with a series of notes which police seized when they cleared

the encampment just as they were settling down for the evening. they advised them they are break the law and illegally lodging and telling them the camp would be raided. they shut down market street and issued the crowd to dis-- issued a warning for the crowd to disburse. they took them to police headquarters and charged them. they started to filter back to the site and said the protest is not over. >> i can't speak for everybody, but as long as i am here, i will be out here doing this and you know, honestly except for people losing their stuff, it makes us stronger and i hope everybody sees that, we are out here for the long run. >> reporter: now coming back to the live picture, you can see there is in fact a large police presence and these are just two

delays either. >> that traffic looks good getting to highway 17 and that is in nice shape to los gatos, thank you steve. we have some thick fog and there is a lot of fog on the coast, still a westerly breeze in place and temperatures are really not that hot. we cool down for many, but upper 40s to 50s. san jose is 54. san rafael is still holding on to 52. it is less than 10 now and that's assure sign for inland temperatures and it is at least the east bay inland temperatures. there is still a low on the coast. high pressure continues to build into the west and that will ensure temperatures. and the coast and the bay have

to wait another day before they warm up. if everything continues to fall into place, we will get a north east whipped and the fog should clear out and not everybody in on this -- not everybody is in on this one. clouds towards the east bay and upper 80s for some to near 90s. no big changes friday, we warm up saturday and sunday and if there is a warmup on the coast it will happen then. a big fire causes major damage to a bay area school and why some say that california's fire code may be to blame. there is a little bit of fire in our picture, i will tell you more about that coming

. they are raising questions about the california fire code. they were there earlier this month and it burned an hour before it was reported. now the school has many portable classrooms but it does not have a monitored fire alarm. state laws do not have spring letters and those -- sprinklers

and they can call for help even if nobody is on the campus. they will hear a defense on marriage act. they are looking into whether same sex marriages should be abandoned or preserved. they have recently struck down the law and the obama administration no longer defends it. the ruling is not expected for months. a couple from new jersey is suing after their picture was used in an antigay attack in colorado. they took their photo without their permission and wrote a caption across it. it was used on mailers against a republican state lawmaker and the group has made no comment on that lawsuit. in election news, president barack obama seems to be

widening nationwide. allison burns is there to talk about one group that seems to be rallying behind the republican nominee. >> reporter: mitt romney is going to be meeting with veterans in ohio and they have a recent poll which shows a double digit lead over obama with veterans. he and his running mate stepped up their calls against looming defense cuts. >> we believe in peace through strength and we believe that when america's military is strong, america is safer. >> reporter: the obama campaign points to oil polls which show the president consistently has strong support from veterans and many veterans are part of the 47% of americans who he has criticized for not paying

income taxes. >> i don't believe we can get very far for the veterans who never take responsibilities for their own lives. >> reporter: allison burns, ktvu channel 2 morning news. we are now hearing from the man who survived the avalanche. he is an extreme skier who grew up in livermore. an much - livermore. the fast moving snow took them 650 feet down the mountain while they were still in their sleeping bags. he said he tried to dig out two of his friends but he could not find them. >> unfortunately, i could not help them and i had to start thinking about my own life. >> three more people are  missing and presumed dead. more than 60 people died on that mountain since the team first climbed it.

look like they are on fair way up as we get to the weekend and there is a big old fog bank on the coast. 60s and 70s coast and bay. oakland 68, 84 concord after yesterday's 78. 86 napa hill and there is a lot of mid-70s even on the peninsular which has been really nice. no big changes, they carry it sunday and monday as they make it to the coast we'll see more tomorrow. european markets are starting the trading day after reports of china, they ejected it into his system. they closed with a 6.2% and nearly the other markets had

francisco. a handful of occupied protesters were kicked out of federal market and they were kicked out and came back. the city has now put up -- you can see for yourself, the city put up a temporary fence to keep them out and keep them from coming back. in the meantime we have exclusive video of what happened in that raid. this happened just before midnight in san francisco. police arrested about two dozen people and they also handed out leaf let's and have been warning the occupiers they would be arrested if they did not leave. they are facing charges of illegal dodging. and now -- illegal lodging. now claudine wong is at the school with the details, claudine? when school starts, the

kids who used to be in, they will find themselves being taught by a substitute teacher teaching entirely different classes and then tonight there will be a meeting at the library so parents can ask questions about what exactly happened. all we can tell you at this point is we know this teacher was arrested at his home in albany on one charge of lewd & lascivious conduct with a child under 14. he whats been -- he has been part of this community for several years. he has been a coach and student council adviser as well as a teacher with several different classes here at the school. now the police department says the arrests came after recent reports of an inappropriate relationship between him and a

former student. he was arrested and was booked in alameda county on $100,000 . now this morning, albany police are asking for information from individuals who may have information about inappropriate conduct from this man including former students and players on teams he has coached. this story is still developing and lots of information is coming up. ktvu channel 2 morning news. a lot of parents were upset about not be notified about a weapon being brought to school. they say a boy reportedly a 5th grader threatened to hurt classmates if they told anybody he was carrying a weapon. the incident happened last wednesday butler's did not go

-- but letters did not go out until this week. an ipad was stolen near fillimore and sacramento streets. it ended where the suspects crashes at haze and beau canon. one of the suspect's grabbed a backpack and then he jumped into the getaway car. then the suspect slammed into several cars including one mini- van seriously injuring another driver and the debris hit a little boy at the playground. >> i was scared, you never know if there are guns in this neighborhood. i ran into one of the stores, and i thought i don't need to see it, i just want to be safe. >> the boy is expected to make a full recovery we are told. three people were arrested but

they did not overreact. >> they say the city has been hit by a string of robberies. officers say they found a young man inside a car who had been shot multiple times. his name has not been released and so far there is no word of a motive or any arrests. it does appear the victim was targeted which is what investigators are saying. the latest crime spike is the reason behind the event. it begins with a rally in march up and down south 1st street. organizers want the city to know they want something done about the crime spike and will work with police to increase patrols. two east bay lawmakers are calling for an oversight hearing on the refinery fire in richmond. last month's fire injured three

still at 52, concord 53. so... >> westerly breeze all the way to the delta, another sign ,along with with that high pressure squashing fog it will be warmer away from the coast. we are waiting for the high to build and coast will cool down and north wind kicks in by the weekend. coast has been dealing with a lot of fog. it is also a sign of inland temperatures and looks hot. temperatures will make it to the coast. warmer inland up to the east, up towards santa clara valley as well. 60s and 70s and 80s, clear lake and again ukiah, walnut creek, 67 alameda, hayward 73 degrees.

some mid-80s from santa clara valley and 50s and 60s on much of the coast. and we will have 77 in palo alto and also woodside. not a lot of change. we'll see if it makes it to the coast but it could be hot this weekend. well, a san jose man is now defending himself after being accused he is trying to poison his girlfriend. well, he said it was really in the woman's bottled water. and the company websites were hacked. how this is affecting websites and we have more on what the hackers will do next. and southbound 101 between novato and san rafael, nice looking drive, we will tell you more about where the traffic is beginning to get slower.

most of it should stop burning off and you may have to deal with reduced visibility. but what areas that don't have fog are on the cool side. we need a cold front coming through to sweep all of this out and warmer towards the east bay and most inland areas, it will stay cool by the coast. 40s and 50s, 53 couldn't correction and san jose had a huge fog bank. -- 53 and san jose had a huge bank. it will clear out most of that fog and it will smash down to 200 feet.

by today, a little bit warmer, forecasted highs upper 50s to near 90 degrees and it is all over the place. novato 78, clear lake 91, venetia 74. walnut creek to brentwood livermore 88 and san leandro 72, lower 80s los gatos, 62 and 76 in fremont. woodside palo alto, san mateo, 50s and 20s and in the -- 60s and in the coast, too much fog. we cooled down and we ramped up big time and we'll see if it makes it to the coast. >> just a few minutes ago, they report worse than expected news about the economy. it dropped more than 13% in august. that is the biggest decline in more than three years. trucks and aircraft is to blame. gas prices will be at record
